SECTION27. AN ACT RELATIVE TO MINIMUM WAGE, PAID FAMILY MEDICAL LEAVE AND THE SALES TAX HOLIDAY. 2022 TRANSPORTATION Massachusetts Department of Transportation, 1595-6380.. For an operating transfer to the Massachusetts Transportation Trust Fund established in section 4 of chapter 6C of the General Laws for grants to municipalities for a winter recovery assistance program; provided, that funds may be expended for transportation projects including, but not limited to: (i) the rehabilitation, reconstruction, resurfacing or preservation of roadways and appurtenances; (ii) the repair or replacement of traffic control devices, signage, guardrails and storm grates; or (iii) road striping or painting; provided further, that funds shall be distributed using a formula based on each municipalitys share of road mileage; and provided further, that not later than December 30, 2022, the Massachusetts Department of Transportation shall submit a report to the house and senate committees on ways and means and the joint committee on transportation that shall include, but not be limited to: (a) the methodology used to distribute funds from this item; (b) a list of all municipalities that received funding for projects through these grants; (c) the amount of grant funds awarded to each municipality; and (d) a description of the projects implemented in each municipality $100,000,000, Commonwealth Transportation Fund.. 100%. Such job order contracts shall have a maximum term of 2 years. The center shall: (1)provide high-quality, pragmatic, agile and affordable fee-for-service technical assistance and consulting on public management issues to public entities; (2)offer practical, low-cost and customized public management training, education and professional development to public officials and aspiring public officials; (3)collaborate with faculty and practitioners on research and initiatives that drive change in public management practices and help remove barriers for improving public management; (4)create publicly-available resources to support public officials; and (5)integrate public management practitioners with students and faculty at the University of Massachusetts at Boston and throughout the University of Massachusetts system in formal and informal ways that strengthen public entities, the center, the University and the world at large. (5)At no time shall the public fund acquire securities of companies on the scrutinized companies list, except as provided in paragraphs (6) and (7). Annually thereafter, the public fund shall file a report with the clerks of the senate and the house of representatives and the attorney general that shall include: (i) the most recent scrutinized companies list; (ii) all investments sold, redeemed, divested or withdrawn in compliance with paragraphs (2) to (4), inclusive, of subsection (c); (iii) all prohibited investments from which the public fund has not yet divested under paragraph (5) of said subsection (c); and (iv) any progress made under paragraph (7) of said subsection (c). (a) As used in this section, the following words shall have the following meanings: Board, the pension reserves investment management board established in section 23 of chapter 32 of the General Laws. If the early voting ballot is accepted, the local election official shall record the date and secure the ballot in its envelope until processing in accordance with law., (b)(1)The local election officers and registrars of every city or town shall allow any registered voter qualified under section 1 of chapter 51 to vote early in person for any: (i) presidential or state primary or biennial state election or primary or election held pursuant to section 140 to fill a vacancy for senator or representative in congress; and (ii) city or town election held on the same day as a primary or election enumerated in clause (i). 10503; (C) be in a form prescribed by the state secretary in accordance with state and federal law; (D) include clear instructions for completing and returning the application; and (E) allow a voter to designate the mailing address to which the ballot shall be sent., (iii)Each application mailed pursuant to this paragraph to a voter in the city of Boston shall include an option, which shall appear prominently on the application, to request a ballot printed in any language available at the voters polling location pursuant to chapter 166 of the acts of 2014., (iv)To minimize mailings and costs, the state secretary may seek to include said applications in any other mailings required by this chapter or otherwise issued to such registered voters at such time; provided, however, that such a mailing shall clearly indicate that applications to vote early by mail are contained therein and that any voter who previously returned an accepted application for an absent voting ballot or early voting ballot in the calendar year need not return an additional application for the applicable primary or election., (v)The applications required pursuant to this paragraph shall be made available on the website of: (A) the state secretary; and (B) each city and town.. (2)The public fund shall determine the companies on the scrutinized companies list prepared pursuant to subsection (b) in which the public fund owns direct or indirect holdings. (e)(1)Prior to the expiration of the term for a person who is incarcerated in a correctional facility, the officer in charge of the facility shall provide, in writing, a document prepared by the state secretary explaining: (i) the voting rights of a person who is incarcerated in a correctional facility upon discharge from a correctional facility; and (ii) instructions for the person to register to vote following discharge from the facility. The report shall include, but not be limited to: (i) the number of ballot applications with postage guaranteed mailed to voters; (ii) where available, the number of ballot applications with postage guaranteed returned requesting a ballot; (iii) the total number of ballots cast by mail; (iv) total cost and amounts paid for using federal funds; and (v) where available, the number of ballot applications that were returned as undeliverable and a description of the reasons why each application was returned, including, but not limited to, a change of address or the intended recipient being deceased. Section 42 of chapter 132 of the General Laws, as so appearing, is hereby amended by striking out, in lines 3 and 4 and lines 8 and 9, the words by certified mail or hand deliver, and inserting in place thereof, in each instance, the following words:- in accordance with guidelines posted by the department. The fund shall be credited with: (i) all payments received from the federal government and allocated to the Massachusetts rehabilitation commission under the Social Security Administration Vocational Rehabilitation Cost Reimbursement Program, 29 U.S.C. Item 1599-2049 of said section 2A of said chapter 102 is hereby amended by striking out the words that the secretary of administration and finance shall transfer $25,000,000 from this item to item 7002-0012 and inserting in place thereof the following words:- that not less than $25,000,000 shall be expended. This sum shall be in addition to any amounts previously authorized and made available for the purposes of this item. Notwithstanding any general or special law to the contrary, for any taxable year beginning on or after January 1, 2022, any amount received from the COVID-19 Essential Employee Premium Pay program established by sections 73 and 82 of chapter 102 of the acts of 2021 for purposes of providing direct financial support to an essential worker shall be deducted from federal gross income for the purpose of determining Massachusetts gross income pursuant to section 2 of chapter 62 of the General Laws; provided, however, that 1-time payments to front-line state employees required to work in-person during the winter of 2020 to 2021 made pursuant to section 82 of said chapter 102 shall not be subject to this section. To the extent feasible, the state secretary shall include on the outer envelope a system that generates a postmark for determining the date upon which the envelope was mailed. Section 47C of said chapter 51, as so appearing, is hereby amended by adding the following paragraph:-, To the extent feasible, the state secretary shall make the statewide list of registered voters contained in the central registry of voters established in this section available to the local election officers at each polling location., SECTION9. (b)Notwithstanding section 46 of chapter 7C of the General Laws, section 44A of chapter 149 of the General Laws, section 39M of chapter 30 of the General Laws or any other general or special law to the contrary, the commissioner may establish a pilot program for the use of job order contracts by: (i) higher education facilities subject to control of the department of higher education; (ii) an agency within the department of correction; and (iii) the division of capital asset management and maintenance with respect to properties for which the division is responsible. These sums shall be in addition to any amounts previously appropriated and made available for the purposes of those items. The most recent version of the Federal Post Card Application shall be one such application that shall be accepted by the state secretary pursuant to this section., (c)An application pursuant to subsection (b) shall permit a voter to request to receive an absentee ballot: (i) by mail, in accordance with section 91B; (ii) by fax; (iii) by email; or (iv) electronically through an electronic system that is approved by the state secretary and allows a voter to receive, mark, verify and cast a ballot electronically; provided, however, that any electronic system approved by the state secretary under this section shall: (A) provide an electronic voter affidavit that may be used for certification of an electronic ballot and signed with a wet signature or hand-drawn electronic signature; and (B) not store personal identifying information beyond the time necessary to confirm the identity of the voter., (d)Upon receipt of a properly executed application for an absentee ballot from a voter, the city or town clerk shall retain the application and, without delay, enter the application in the voter registration information system.
